GENERAL CONDITIONS OF SALE

            (a) Buyer", the person whose order for goods is accepted by the seller.

• (b) "Products", the products specified on the delivery note to which these conditions are annexed.

  (c) "Seller", KFS OILS LIMITED

1. These Conditions apply except insofar as they are inconsistent with any express agreement entered into between the Seller and the Buyer before the delivery.

2. Acceptance of the product(s) to which the invoice relates will be treated as an acceptance of these conditions.
3. The Buyer will provide a safe and convenient access for the Seller and its agents to the property to the Premises (G) The Buyer is responsible for ensuring that a full and correct address for the Premises (including Postcode) is provided to the Company when the Products are ordered.
4. The price to be paid in respect of any order received or delivered shall be the price ruling at the date of delivery of the order, not the date of order, and where the delivery of any order is made in more than one consignment, the price for each consignment shall be at the price ruling on the date on which such consignments are delivered. Such price shall reflect any tax, duty, or other imposition in respect of the product (s) (other than Value Added Tax).
5. We reserve the right to revise the price without notice.
6. The Seller does not accept responsibility for the dipping, checking or testing of the Buyer's tanks. The Buyer shall be responsible for ensuring that the storage tank to which the delivery is made is a properly constructed, installed and maintained tank, and will accommodate the full quantity ordered. The buyer shall also indemnify the Seller against any damages, injuries, claims, expenses, or costs which may arise as a result of the Buyer not observing these conditions.
7. The Oil is for the Buyer's own use and not for resale (unless the Buyer is a retailer and holds a current Market Fuel Traders Licence) The oil is not to be used as fuel in mechanically propelled vehicle for use on the roads.
8. The Buyer is responsible for ensuring that there is sufficient capacity (ullage) in its tanks to receive the full amount of Product ordered. If there is not sufficient capacity for the volume of Product ordered a service charge of [Eur50] will be applied.
9. Risk in the product shall pass to the Buyer on delivery but title in the products shall remain with the Seller until payment therefore in full has been received by the Seller.
10. The quantity shown by the Seller's measuring device shall be accepted by the Buyer as the quantity delivered, however the Buyer is not permitted from taking measurements to verify them; the Seller cannot accept any responsibility whatever for discrepancies in the Buyer's tank, dip rods or other measuring devices.
11. The Seller shall not accept liability for any change in the quality of the product after delivery has been effected arising from unsuitability of the Buyer's storage/handling facilitated.
12. Sellers measurement of quantity will be accepted by buyers.
13. If there is no outside access to effect the delivery, the Seller will complete the delivery by a connecting hose laid through the premises of the Buyer, in these circumstances the Buyer hereby indemnifies the Seller against any loss or damage to the premises or its contents as a result of spillage or damage to the hose.
14. The Seller shall not be responsible for any failure to make deliveries if fulfilment has been delayed, hindered or prevented by any circumstances whatsoever which are not within the Seller's immediate control.
15. Delivery will normally take place within one to two working days of receiving an order but during busy times and in poor weather conditions it may take longer. We will make every effort to make a prompt delivery but cannot accept responsibility for delays caused by circumstances beyond our control. If for any reason we are unable to fulfill a delivery for an order which has been placed and paid for we will refund in full the value of the order placed. The refund will be processed back via the mode of payment the Buyer used to place the order either cash, debit or credit card used to place the order.
16. This product supplied is FLAMMABLE, and in the event of fire, a CO2 foam or dry powder extinguisher should be used. DO NOT USE WATER as this could spread the fire. (b) Avoid handling the product, if splashed into the eyes or swallowed, seek immediate medical assistance.
17. No agent or employee of the seller is permitted to alter or vary these conditions in any way unless expressly authorised to do so by the seller. If the buyer fails to adhere to these conditions, the seller shall be entitled to stop further deliveries under accepted or partly completed orders.
18. These Terms & Conditions shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Ireland.
